BACK TO Site Usage > Definitions

The following definitions will help you to determine what type of license fits your needs as well as clarify some terminology on our site. Please feel free to contact us if any confusion remains.

n

Art Print - available for purchase to put in your home, office, or other building as artwork. You are NOT allowed to reproduce these prints in any form without purchasing the right to do so.

Company Represented - the company whose product or service oversees the "End User". In some self promotion cases, this entity may be the same as the "End User". So 'Focus on the Family' would be the Company Represented for a purchase of an image for the end user 'Focus on the Family International'. The Company Represented is defined by the purchaser during the check out process.

Copyright -  the unencumbered use of property. The copyright is always owned by the creator of property until legally relinquished by the owner. My consignment photographers and I own the copyrights to the images until they sell that right. America the Beautiful Photos is the agent that assigns, or licenses, the use-rights on behalf of the consignment photographers. Penalties of up to $100,000 are awarded for copyright infringement. Please ask before purchasing if you are not sure of the rights that you are purchasing from this site.

End User - the Use-License for some image categories (such as Rights Managed images) is limited to use by a single "End User". The End User is the entity that benefits from their association with the photo license purchased. This could be a product name, ad campaign, a Web site URL or a person within an organization, etc. In general it is the entity for which there is no further subdivision. For example if the photo is to be used on an advertising poster for Taste Right Cola made by Bob's Bottling Company, the End User is 'Taste Right Cola', not Bob's Bottling Company. If Web-site-only rights are purchased, the End User is the URL of the home page, of the Web site. The End User is named by the purchaser during the purchasing process.

File Size - limited by the size of the original media on which the photograph was captured. I license a few different sizes of files. Each file size has specifications as the dots per inch (dpi) and the overall size that it will print:  for instance, at 300 dpi (an accepted standard for quality printing on an offset or digital press). For example, you will see specifications such as 4MB/300 dpi/11" x 14" on this Web site. This means that the image takes up approximately 4 MegaBites of computer disk space, allows for 300 dots of ink per inch of printed material, and will yield a maximum print size of 11" x 14" at 300 dpi.

License or Use-License - refers to the method that we transfer rights to use images. Images are generally licensed, not purchased, from this Web site. The industry calls this assigning of rights "Licensing" or purchasing a "Use License". Licensing varies greatly from Web site to Web site, so be sure you read the license agreement for each purchase so that you know how you are allowed to use an image. You can purchase the original copyrights from the photographers in most cases if you feel you want to own the image. The individual photographer will set the price.

Rights Managed - the End User's rights to use the image are strictly limited. Every Web site has it's own rules as to what rights they are selling with the photographs. Images on America the Beautiful Photos are limited to a single End User, a defined distribution number, with a time limit for use. The use period and distribution can be extended by re-purchasing the rights.

Royalty-Free - you can use the images for any use not prohibited in the license without further fee. You may not distribute copies of the images, only the items created with the images.

Use Period - the amount of time a purchaser or End User has to make use of an image. If you purchase a use-license for a Rights Managed image on this site, the named End User has the right to print the image for up to four years. The image can be seen after four years, but must be printed and originally distributed within those four years. If you purchase a Royalty Free image, you may print or show the image without time constraint.
